Father Given Suspended Sentence for Operating Illegal Waste Business with Son

Michael Joseph Richards, 59, currently residing at Menorca Lane, Bugle, was sentenced for two offenses related to the illegal waste operation he ran with his son, also named Michael, at their former residence at The Paddocks, St Stephen’s Road, Sticker.

Richards Senior received an 18-week prison sentence, suspended for two years, at Bodmin Magistrates Court on 18 May 2023.

Richards Junior was fined for three offenses linked to the business last month. Additionally, Richards Senior was required to cover half of the previously awarded costs amounting to £4,397.75.

This case, initiated by the Environment Agency, saw both men admit to charges concerning the operation of a waste site without the necessary permit.

The Environment Agency commenced an investigation following a fire at the site, where various building and household wastes—including plasterboard, timber, cement bags, rigid insulation, electrical appliances, furniture, and plastic items—were stored.

Surrounding the fire was additional waste debris such as radiators, fridges, and a caravan. The fire’s proximity to a gas tank and the main A390 road raised concerns about potential smoke hazards.

Magistrates remarked that waste crime is among the most serious offenses they encounter and noted that Richards neglected to oversee activities on his property.

Following the court session, Stephen Clark from the Environment Agency stated:

We’re satisfied with the outcome of this case. Mr. Richards Senior has a prior similar conviction. This sends a clear message that waste crime will not be tolerated.

Background

Michael Richards Senior admitted guilt to two charges:

Between 21 September 2020 and 25 June 2021, he permitted the operation of a waste site at The Paddocks, St Stephens Road, Sticker, St Austell, without an active environmental permit.

In violation of regulations 38(1)(b) and 12(1)(b) of the Environmental Permitting (England and Wales) Regulations 2016.

From 21 September 2020 to 25 June 2021, he deposited, or knowingly caused or permitted the deposit of controlled waste, including mixed building and household waste, on land, specifically The Paddocks, St Stephens Road, Sticker, St Austell, without an active environmental permit.

In violation of section 33(1)(a) of the Environmental Protection Act 1990.
